Ad-Vantage Networks, Inc. and its affiliates (“AdVantage” “we” “us” or “our”) are committed to respecting your privacy. This privacy policy (“Privacy Policy”) describes our policies and practices relating to the collection and use of information in connection with our website, located at www.advn.com (“AdVantage Site”), and our delivery of advertising services (“Advertising Services”) on the AdVantage Network, defined in Section I below.
Your use of the AdVantage Site or the Advertising Services serves as an acknowledgment that you understand and agree to the terms of this Privacy Policy set forth herein. Please read this Privacy Policy carefully to learn about the types of information we may collect, how we use and sometimes share such information, and other important specifics relating to user privacy on the AdVantage Site and the AdVantage Network.
I. What We Do
AdVantage delivers Advertising Services to advertisers on the AdVantage Network, which consists of private internet networks, Internet service providers (ISPs), multiple system operators (MSOs), transactional network partners and other web properties that are either owned, operated and controlled by AdVantage, or owned, operated, and controlled by third parties but on which we have a contractual right to place advertisements via these providers (“AdVantage Network”). We also run and administer the AdVantage Site to provide information to the general public and potential business partners about AdVantage, including where and how such parties can contact us.
All data collection and use by AdVantage in connection with our delivery of the Advertising Services on the AdVantage Network is subject to an agreement between AdVantage and the participating providers within the AdVantage Network described in the paragraph above (“AdVantage Network Providers”) and subject to the privacy policies of such AdVantage Network Providers.
II. InformationCollection and Use
Non-Personally Identifiable Information
Like most web properties, we collect usage information about how the AdVantage Site and the properties within the AdVantage Network are accessed and utilized by users in order to help improve our services to you and allow AdVantage and the AdVantage Network Providers to create advertising and other content customized to your interests.
This information may include, but is not limited to, your browser type, platform type, operating system, which advertisements and other content you viewed, links you may have clicked on, the type of sites you have visited where a certain advertisement was delivered, and the amount of time you spent viewing a particular advertisement. We may also collect information that identifies the device(s) you use to access and utilize the AdVantage Site or the AdVantage Network Provider properties, such as your Internet protocol (IP) address, media access control (MAC) address, or other device identifier to help us better understand your physical location in order to customize the content you are viewing and improve our services to you. We do this by creating an anonymous profile assigned to your device(s) that is based on a unique numeric identification.
We may also collect non-personally identifiable information to administer our business for such purposes that include, but are not limited to, the calculation of payments due under an applicable insertion order or other payments owed to AdVantage or an AdVantage Network Provider.
While the type of information described in this Section II “Non-Personally Identifiable Information” does not typically identify a user specifically and personally, we may from time to time associate this type of information with information that does identify a user specifically and personally, in which case we will treat all such information as personally-identifiable information.
The monitoring technologies we may use to collect non-personally identifiable information include, but are not limited to, those described in the “Cookies, Web Beacons and Other Technologies” Section immediately below.
Cookies, Web Beacons and Other Technologies
We may utilize cookies, web beacons and other monitoring technology devices to collect non-personally identifiable information regarding your use of the AdVantage Site or an AdVantage Network Provider property, whether such devices are placed by AdVantage or a third party. Any and all placement or other use of these devices by AdVantage on a property of an AdVantage Network Provider is subject to an agreement between AdVantage and such AdVantage Network Provider and subject to the privacy policies of such AdVantage Network Provider, and any collection of data by AdVantage via placement of such devices by a third party is subject to an agreement between AdVantage and such third party and the privacy policies of such third party.
Cookies are data files stored on your computer for the purposes of identifying your specific browser during interactions on a website. We may use “session,” “persistent,” “flash” or “browser” cookies to better understand your usage activity. Most browsers will allow you to refuse cookies as you are notified of their receipt, disable existing cookies, or have browser settings that allow you to reject cookies automatically.
Web beacons are small amounts of code that allow a website to collect information through a graphic image request. We may use web beacons in conjunction with cookies to collect click-stream data used for advertisement delivery and reporting purposes, as well as to help track how you interact with an advertisement displayed on a property within the AdVantage Network.
We may also collect information on a user through our web servers and server logs when an advertisement on the AdVantage Network is displayed to the user.
Personally-Identifiable Information
By using the AdVantage Site or the Advertising Services, you may provide us with information on your own accord that may be used to identify or contact you, such as your name, email address, billing address, phone number or payment information. Instances where we may collect this information include when you provide us information on behalf of an entity looking to utilize the Advertising Services (e.g. when you fill out an insertion order or other relevant documentation pursuant to a purchase made for an advertisement delivered by AdVantage) or when you contact us by email, via the contact form on the AdVantage Site, or in another manner.
Any personally-identifiable information we collect is information that was specifically and knowingly provided to us. We do not sell or share personally-identifiable information with third parties except as otherwise provided in this Privacy Policy.
III. Information Sharing with Third Parties
Generally
We may share non-personally identifiable information (examples provided in Section II “Non-Personally Identifiable Information”) we collect about your use and interaction with the AdVantage Site or a property within the AdVantage Network with AdVantage Network Providers, advertising partners and other third parties in order for such parties to create advertising and other content customized to your interests.
We may also partner with certain service providers we utilize in connection with the delivery of the Advertising Services or to help administer the AdVantage Site or the Advertising Services, and we may share personally-identifiable information with such providers and any entities under a common control with us for these, but for only these, specific purposes. We may also share personally-identifiable information about our users where they have consented to the sharing of such information with a third party.
From time to time, we may receive information about you from third parties. In such instances, our policies and practices set forth in this Privacy Policy will apply to any collection, use and sharing of such information by AdVantage.
Business Transfers
In the case of a merger, consolidation, sale, acquisition, reorganization, liquidation or other transfer of ownership of AdVantage to another entity, all personally identifiable and non-personally identifiable information collected by AdVantage as described in this Privacy Policy may be transferred to an affiliated entity in connection with such transfer.
For Legal Reasons
We may share personally identifiable and non-personally identifiable information we collect to exercise our legal rights, to protect another party’s rights, to investigate or take other action for the purposes of fraud detection or other suspicious or illegal activity, to investigate violation of any of AdVantage’s policies or terms and conditions regarding the AdVantage Site or the Advertising Services, and/or to respond to subpoenas, court orders, search warrants, or otherwise comply with the law.
Children
We do not knowingly collect or maintain personally-identifiable information about anyone under 13 years of age, and if we discover that we have inadvertently collected such information we will take steps to delete it as soon as possible. In the event a parent or guardian believes that such personally-identifiable information has been collected from their child, he or she may request that we to delete it as soon as possible.
IV. Opting Out of Advertisements from AdVantage
If you are visiting or otherwise interacting with a website or other property within the AdVantage Network as an individual Internet consumer, you may opt out of receiving advertising from AdVantage by clicking here or by opting out directly on an AdVantage Network Provider property. We require that all AdVantage Network Providers provide this opt-out feature on their properties. If you choose to opt out, you may continue to receive advertisements from other advertisers who purchased inventory on the AdVantage Network Provider property you are viewing, but will not receive targeted advertisements on that property we deliver as part of the Advertising Services.
The opt out function works via placement of a cookie on your computer that notifies us or the AdVantage Network Provider that you no longer wish to receive such advertisements. If this cookie is deleted, you will need to complete this opt-out process again for the opt out to go into effect. If you use more than one computer or browser, you will need to complete this process on each computer and on each browser for the opt out to be effective.

V. Limitation of Liability
YOU HEREBY UNDERSTAND AND ACKNOWLEDGE THAT ANY AND ALL DISPUTES RELATING TO THE PRIVACY POLICIES OR PRACTICES OF ADVANTAGE IS SUBJECT TO THIS PRIVACY POLICY, AND THAT ADVANTAGE’S TOTAL OBLIGATIONS AND/OR LIABILITY FOR ANY SUCH DISPUTES OR CLAIMS SHALL BE THE VALUE OF ADVANTAGE’S SERVICES PROVIDED TO YOU OR $500, WHICHEVER IS GREATER.ADVANTAGE HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO INFRINGEMENT, SATISFACTORY QUALITY, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
VI. Security
We make efforts to ensure data security on our systems to protect against unauthorized access to and unauthorized alteration, disclosure or destruction of data. In instances where you provide us with personally-identifiable information or information regarding your business to utilize the Advertising Services or engage in other business with AdVantage as a web publisher, advertiser, AdVantage Network Provider or other third party, we will take reasonable efforts to protect such information. However, no data transmissions over the Internet can be guaranteed to be secure. As a result, we cannot ensure or warrant the security of any information you transmit to AdVantage and you do so at your own risk.
VII. Changes to Privacy Policy
We may make changes to this Privacy Policy in our sole discretion at any time by posting such changes on the AdVantage Site. Please check back to this Privacy Policy so you are aware of AdVantage’s most current data collection and use policies and practices.
VIII. Miscellaneous
You hereby represent and warrant that you have obtained any and all necessary consents from any third parties whose data you provide to us.
This Privacy Policy shall be governed by the laws of the State of California without regard to the conflict of law provisions thereof and you consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of California and County of Los Angeles.
